Physical Custody in Texas

In Texas, physical custody means possession. A "possessory conservator" is the parent who has physical custody of a child. According to the Texas Family Code, the proper term for custody is conservatorship.

Texas Conservatorship Laws

An individual with custody by order of court is referred to as a "conservator," there are 3 types of conservatorship: joint managing conservator, sole managing conservator, and possessory conservator (physical custody)

What Does Sole Managing Conservator Mean?

A sole managing conservator is the parent that has exclusive rights to make decisions for a child. There are a number of decisions that may cause a court to decide one parent should have sole custody, including:

  • family violence
  • child abuse / neglect
  • alcohol & drug abuse
  • parental absence

Texas Joint Managing Conservatorship Laws

Under Texas law, both parents typically enter into a joint managing conservatorship. This means that both parents are responsible for decision-making on most important issues, such as education and healthcare. A joint managing conservatorship does not necessarily mean that the time is split equally between both parents. Time spent with a child is determined by the visitation orders.

Visitation Rights in Texas

In Texas, visitation rights are referred to as "periods of possession." Non-custodial parents have visitation rights according to Texas Family Code typically based on the Standard Possession Order which dictates a visitation schedule.
