Drug Trafficking Attorney Dallas, TX

Texas Drug Trafficking Laws

Drug trafficking occurs when somebody delivers or transports a controlled substance from one location to another. Depending on the circumstances, the offense can be charged as either a state or federal crime. Regardless of which jurisdiction it's prosecuted under, the conviction penalties are severe, resulting in years of incarceration and/or thousands to millions of dollars in fines. Not to mention, having a mark on a criminal record can make it difficult for the individual to readjust to society even after they have served their time.

Challenging Drug Trafficking Charges in Texas

When state or federal prosecutors take on drug possession cases, they must prove that the defendant knowingly or intended to transport a controlled substance. Although they might have evidence against the defendant, that does not mean it's enough for them to convince a judge or jury that the individual is guilty beyond a reasonable doubt.

If you've been accused of drug trafficking, pleading guilty is not the only course of action you can take. You may have other options, and our Dallas drug trafficking lawyers are ready to review them with you and answer any questions you might have. We'll thoroughly examine every detail of your case, including the evidence against you and the details about your arrest to spot hole's in the government's allegations and determine what defenses may be raised on your behalf.

Texas Drug Trafficking Penalties

As mention earlier, drug trafficking is a state or federal crime. The penalties depend on whether you were convicted in state or federal court, what substance you were accused of trafficking, and the amount of the drug you allegedly tried to transport.

For instance, in Texas, heroin and cocaine are classified as Penalty Group 1 drugs.

If you're convicted of knowingly delivering less than 1 gram of heroin or cocaine, which is a state jail felony, you may be punished by:

  • Up to 2 years imprisonment, and/or
  • Up to $10,000 in fines

For knowingly trafficking 4 to 200 grams, the penalties you could face include:

  • Up to 99 years in prison, and/or
  • Up to $10,000 in fines

The federal penalties for trafficking heroin or cocaine are different from the state's.

Delivering 1 kilogram or more of a substance containing heroin or 5 kilograms or more of a substance containing cocaine can result in:

  • Up to 10 years imprisonment, and/or
  • Up to $10,000,000 in fines (if the defendant was an individual)

If the use of the drug resulted in serious bodily injury or death, the imprisonment term increases to 20 years to life.
